These Terms of Service (“Terms”) govern your use of the Part Xperts USA website and your purchase of products from Part Xperts USA (“Part Xperts USA,” “we,” “us,” or “our”).

By accessing our website, placing an order, or purchasing a product from us, you agree to these Terms, along with our Shipping Policy, Return and Refund Policy, 90-Day Money-Back Guarantee, Privacy Policy, and any additional terms disclosed in an individual product listing.

Unless a listing specifically states otherwise, products should be assumed to be used rather than new.

Because our products are used, normal signs of previous use may be present. These may include:

Normal cosmetic wear does not mean that a part is defective.

Customers should carefully review the entire listing, photographs, part numbers, descriptions, and compatibility information before purchasing.

2. PRODUCT PHOTOS AND DESCRIPTIONS

We make reasonable efforts to ensure product photographs and descriptions accurately represent the item being sold.

Because used automotive parts can vary significantly even among vehicles of the same year, make, and model, photographs, part numbers, option codes, connector styles, mounting locations, production dates, and other identifying information should be reviewed carefully.

When a listing states that photographs are representative or stock images, the actual item received may differ cosmetically from the photograph while remaining functionally equivalent to the product described.

Minor differences in appearance that do not affect the intended function of the part are not necessarily considered defects.

Obvious typographical, pricing, inventory, or listing errors may be corrected at any time. If an error materially affects an order that has already been placed, we may contact you before fulfilling the order.

3. FITMENT AND VEHICLE COMPATIBILITY

Vehicle fitment must be verified before installation.

It is the buyer’s responsibility to confirm that a purchased part is correct for the intended vehicle unless we expressly guarantee compatibility in writing for that specific transaction.

Year, make, and model alone may not be sufficient to determine compatibility.

Vehicles that appear identical may use different components depending on factors including:

  • Trim level

  • Emissions configuration

  • Part number

  • Interchange number

  • Connector configuration

Before installation, compare the received part against the original part, including applicable part numbers, connectors, mounting points, dimensions, and other identifying characteristics.

A properly functioning part that does not fit because an incorrect part was ordered is not considered a defective part under our 90-Day Money-Back Guarantee.

4. VIN AND VEHICLE INFORMATION

We may request your vehicle identification number (“VIN”), production date, original part number, or other vehicle information to assist with compatibility.

Providing this information does not automatically constitute a guarantee of fitment unless we expressly confirm compatibility in writing.

Customers are responsible for providing complete and accurate vehicle information.

If the product appears incorrect, damaged, or materially different from the listing, contact us before installation.

Installing a visibly incorrect or damaged item may affect return eligibility.

6. PROFESSIONAL INSTALLATION

Automotive repair can involve safety-critical systems and specialized installation procedures.

Parts should be installed using appropriate procedures, tools, fluids, torque specifications, programming procedures, and manufacturer requirements.

Certain parts may require professional installation, calibration, relearning, coding, programming, alignment, fluid replacement, system flushing, or other procedures before they will function correctly.

Failure of a component resulting from improper installation, incorrect programming, contamination, another defective vehicle component, insufficient lubrication, overheating, incorrect fluid, electrical faults, or other external causes is not considered a covered part failure.

7. ELECTRICAL AND ELECTRONIC PARTS

Electrical and electronically controlled automotive components may require programming, coding, calibration, initialization, or relearning after installation.

They may also be affected or damaged by pre-existing electrical problems in the vehicle.

Examples include, but are not limited to:

  • ECMs

  • ECUs

  • PCMs

  • BCMs

  • Control modules

  • Instrument clusters

  • Radios

  • Infotainment systems

  • Navigation units

  • Cameras

  • Sensors

  • Switches

  • Wiring

  • Fuse boxes

  • Relays

  • Electronic actuators

  • Electronic throttle components

  • Electric motors

  • Starters

  • Alternators

  • Other electronically controlled components

Unless specifically stated otherwise in the listing or warranty terms, electrical and electronic parts are excluded from our 90-Day Money-Back Guarantee.

8. ENGINES

Unless specifically stated otherwise, a used engine is sold and warranted as the engine long block.

This generally refers to the engine block, cylinder heads, and internally lubricated mechanical components.

Parts that may remain attached to an engine for convenience are not automatically included in warranty coverage.

Examples may include:

Before installing a used engine, the installer should perform all maintenance and installation procedures reasonably necessary for proper operation.

This may include replacement or inspection of appropriate seals, gaskets, filters, fluids, belts, hoses, thermostat, water pump, timing components, and other service items depending on the engine and manufacturer requirements.

Engine damage caused by overheating, oil starvation, contamination, insufficient lubrication, cooling-system problems, improper installation, or continued operation after a warning condition appears is not covered by our 90-Day Money-Back Guarantee.

9. TRANSMISSIONS

Unless otherwise stated, used transmissions are sold and warranted as the transmission assembly and internally lubricated mechanical components.

Components that may remain attached to the transmission are not automatically warrantied.

This may include:

  • Wiring

  • Harnesses

  • Mounts

  • Transmission lines

10. BODY AND COSMETIC PARTS

Used body parts may contain normal cosmetic wear.

Paint codes are provided for identification purposes when available but do not guarantee an exact color match.

Vehicle paint can change because of age, sun exposure, refinishing, environmental conditions, manufacturing variation, and previous repairs.

Customers should assume that used painted body parts may require refinishing.

Previously disclosed scratches, dents, scuffs, paint damage, fading, or similar cosmetic conditions are not considered defects under our warranty.

11. ORDERS

Submitting an order does not automatically guarantee acceptance.

We reserve the right to accept, decline, or cancel an order when reasonably necessary, including because of:

  • Inventory errors

  • Pricing errors

  • Listing errors

  • Suspected fraud

  • Payment problems

  • Shipping restrictions

  • Incorrect product information

  • An item becoming unavailable

  • Damage discovered before shipment

If we cancel an order after payment has been collected, the applicable amount will be refunded.

12. INVENTORY AVAILABILITY

Because many used automotive parts are unique inventory items, availability may change without notice.

An item may occasionally be sold through another sales channel before our inventory systems synchronize.

If an ordered item is no longer available, we may cancel the order and issue a refund or, with your agreement, offer a comparable alternative.

13. PRICING

Prices may change without notice.

We reserve the right to correct obvious pricing, typographical, or listing errors.

If a significant pricing error is identified after an order is placed, we may cancel the affected order and refund the payment rather than fulfill an order at an obviously erroneous price.

14. PAYMENT

You agree to provide current, complete, and accurate payment and billing information.

By submitting payment information, you represent that you are authorized to use the selected payment method.

Orders may be delayed or canceled if payment cannot be verified or if fraud-prevention systems identify unusual activity.

15. FRAUD PREVENTION

We reserve the right to verify orders before shipment.

16. SHIPPING

Orders are shipped according to our Shipping Policy.

Delivery dates provided by us or a shipping carrier are estimates unless expressly stated otherwise.

Shipping may be affected by carrier delays, weather, holidays, incorrect addresses, transportation interruptions, freight scheduling, natural disasters, or other circumstances beyond our reasonable control.

Customers are responsible for providing an accurate and complete delivery address.

17. FREIGHT SHIPMENTS

Large automotive components may require freight delivery.

Freight shipments may require:

  • A valid telephone number

  • Delivery appointment

  • Commercial delivery address

  • Loading dock

  • Forklift

  • Liftgate service

  • Terminal pickup

  • Other special arrangements

Additional carrier charges resulting from residential delivery, re-delivery, storage, address changes, limited-access locations, or services requested by the recipient may be the customer’s responsibility when those charges were not included in the original shipping price.

Inspect freight shipments for visible damage before accepting delivery whenever reasonably possible.

Any visible damage should be documented on the carrier's delivery paperwork and photographed immediately.

18. SHIPPING DAMAGE

Customers must inspect delivered products promptly.

If an item is damaged during shipping, contact us as soon as possible.

Do not discard the:

  • Shipping box

  • Pallet

  • Packaging material

  • Shipping label

  • Freight paperwork

  • Damaged product

We may require photographs or other documentation to process a carrier claim.

19. 30-DAY RETURN POLICY

Part Xperts USA offers a 30-day return period subject to the conditions contained in our Return and Refund Policy.

The 30-day standard return period is separate from the 90-Day Money-Back Guarantee.

The standard return policy generally applies to eligible products returned because the customer changed their mind, ordered an incorrect part, or no longer needs the product.

Returned products must satisfy the conditions described in our Return and Refund Policy.

20. 90-DAY MONEY-BACK GUARANTEE

Qualifying non-electrical parts are covered by our 90-Day Money-Back Guarantee as described in our Return and Refund Policy.

This is a limited, parts-only guarantee covering qualifying mechanical failure during the applicable warranty period.

The guarantee does not extend the standard return window to 90 days for:

  • Change-of-mind returns

  • Parts that are no longer needed

Warranty claims must satisfy the requirements contained in our Return and Refund Policy.

21. WARRANTY CLAIMS

A customer requesting coverage under our 90-Day Money-Back Guarantee may be required to provide information reasonably necessary to evaluate the claim.

  • Mileage

  • Original part number

  • Description of the failure

  • Diagnostic information

Do not dispose of, disassemble, rebuild, or materially modify a claimed defective part unless we authorize you to do so.

The returned product must be the same product originally purchased from Part Xperts USA.

Identification markings, inventory markings, serial numbers, or warranty markings must remain intact when applicable.

22. WARRANTY EXCLUSIONS

Unless otherwise required by applicable law, warranty coverage does not apply to damage or failure caused by:

  • Improper installation

  • Incorrect fitment

  • Accident or collision

  • Abuse or misuse

  • Neglect

  • Racing or competition use

  • Abnormal or unintended use

  • Off-road use when the part was not designed for such use

  • Modification

  • Alteration

  • Unauthorized disassembly

  • Welding or cutting

  • Overheating

  • Oil starvation

  • Insufficient lubrication

  • Incorrect fluids

  • Fluid contamination

  • Improper maintenance

  • Electrical problems

  • Wiring faults

  • Voltage problems

  • Programming errors

  • Failure of another vehicle component

  • Continued vehicle operation after a problem becomes apparent

  • Failure to follow applicable manufacturer installation procedures

  • Removal or alteration of identifying markings

Normal wear and tear is not considered a warrantable failure.

23. LABOR AND CONSEQUENTIAL EXPENSES

Unless expressly agreed to by us in writing, Part Xperts USA sells automotive parts and does not provide reimbursement for installation or removal expenses.

Our warranties do not cover:

  • Labor

  • Installation costs

  • Removal costs

  • Diagnostic charges

  • Programming charges

  • Calibration charges

  • Towing

  • Storage

  • Rental vehicles

  • Transportation

  • Lost wages

  • Lost profits

  • Loss of vehicle use

  • Shop supplies

  • Fluids

  • Related repair costs

  • Damage to other components

Our 90-Day Money-Back Guarantee is limited to the qualifying purchased part and the remedies expressly described in the Return and Refund Policy, to the extent permitted by applicable law.

24. RETURN SHIPPING

Return shipping responsibility depends on the reason for the return and the terms stated in our Return and Refund Policy.

Do not send an item back without obtaining return authorization.

Unauthorized returns may be refused or delayed.

Oversized or freight products must not be independently shipped back without receiving return instructions from us first.

25. REFUNDS

Where mandatory marketplace rules apply to a transaction, those rules may control the handling of that particular transaction.

28. NO UNAUTHORIZED CHARGEBACKS

Customers should contact us first when there is a problem with an order so we have an opportunity to investigate and resolve the issue.

Nothing in these Terms eliminates any lawful right you may have to dispute a charge with your card issuer or payment provider.

However, knowingly filing a false or fraudulent chargeback, claiming that a delivered product was never received when it was received, returning a different item, or otherwise misrepresenting transaction facts may constitute fraud.

29. OWNERSHIP OF RETURNED PARTS

A customer receiving a refund for a product may be required to return that product to us.

Issuance of a refund does not authorize the customer to retain both the refunded purchase price and the product unless we specifically state in writing that return of the item is unnecessary.

30. CORES

If a product includes a core charge or requires return of an original component, any applicable core-return requirements will be disclosed in the product listing or order documentation.

A returned core may be rejected if it is incomplete, materially different from the required core, disassembled beyond acceptable condition, or otherwise fails the stated core-return requirements.

31. INSTALLATION DOES NOT TRANSFER LIABILITY

Installation of a Part Xperts USA product does not make Part Xperts USA responsible for the condition of the customer's vehicle or other vehicle systems.

Automotive components frequently operate as part of interconnected mechanical, hydraulic, electronic, cooling, lubrication, and control systems.

A failure involving the customer's vehicle does not by itself establish that the purchased part was defective.

32. DIAGNOSTIC INFORMATION

Diagnostic trouble codes, mechanic statements, scan-tool results, or similar information may help us evaluate a warranty claim but do not automatically establish that the purchased part itself failed.

We may reasonably request additional information or inspection when necessary to determine the cause of a reported problem.

33. PRODUCT SAFETY

Do not continue operating a vehicle if a newly installed component appears to be malfunctioning or if the vehicle displays warning signs such as:

  • Overheating

  • Loss of oil pressure

  • Fluid loss

  • Abnormal noise

  • Smoke

  • Electrical burning smell

  • Brake malfunction

  • Steering malfunction

  • Other significant safety warnings

Continued operation after a known problem can cause additional damage and may affect warranty coverage when the continued operation causes or materially contributes to the claimed failure.

34. INTELLECTUAL PROPERTY

Website content owned by Part Xperts USA, including text, graphics, logos, photographs, product descriptions, page layouts, and other original materials, may not be copied, reproduced, republished, distributed, or commercially used without permission except as permitted by law.

Third-party trademarks, vehicle manufacturer names, logos, and part numbers remain the property of their respective owners.

Use of manufacturer names or part numbers is for product identification and compatibility purposes and does not imply affiliation, authorization, or sponsorship unless expressly stated.

35. PROHIBITED USE

You may not use our website or services to:

  • Violate applicable law

  • Commit fraud

  • Submit false payment information

  • Attempt unauthorized access to our systems

  • Introduce malicious software

  • Scrape or reproduce protected website content for unauthorized commercial purposes

  • Interfere with website security or operation

  • Impersonate another person

  • Submit knowingly false warranty or return claims

36. THIRD-PARTY SERVICES AND LINKS

Used automotive parts inherently vary in age, mileage, cosmetic condition, prior use, and remaining service life.

Except for warranties or guarantees expressly provided by us in writing and any warranties or rights that cannot lawfully be excluded, products and website services are provided subject to the condition and descriptions disclosed at the time of sale.

Nothing in these Terms is intended to disclaim or restrict an implied warranty or other consumer right when applicable law prohibits us from doing so.

The FTC notes that implied warranties may apply to consumer products depending on state law and that written warranties can affect how implied warranties may be limited.

39. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Part Xperts USA's liability arising from the sale of a product will not exceed the amount paid to Part Xperts USA for the product giving rise to the claim.

To the fullest extent permitted by applicable law, Part Xperts USA will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the purchase, installation, use, removal, or failure of a product.

These limitations do not apply where applicable law prohibits such limitations.

40. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold Part Xperts USA harmless from third-party claims arising directly from your unlawful use of our website, fraudulent conduct, violation of these Terms, or misuse or unauthorized modification of products purchased from us.

This provision does not require a consumer to indemnify us for our own negligence, misconduct, or violation of law.

41. CONSUMER RIGHTS
